Abstract

In the early 1980s, Malaysia began to amend and enforce a specific law relating to the Islamic Family Law. This law aimed at improving Islamic Family Law administration and rearranging the provisions in a more orderly manner to guarantee better protection of the rights of Muslim women in family matters. Although the provisions are detailed and comprehensive, there still are many reported cases of Muslim women facing difficulties in claiming their rights and entitlements after divorce. Most of these difficulties stem from their lack of information, awareness and knowledge of their rights and procedures to make such claims as stipulated by law. Their awareness and knowledge of rights and entitlements after divorce is important to avoid abuse and injustice. The purpose of this article is to analyze the level of awareness on their rights after divorce among Muslim women in Kota Bharu, Kelantan. Specifically the analysis is carried out to gauge the difference in the level of women’s awarness of their rights after divorce based on age, educational background, and marital status. Questionnaires were distributed to 384 Muslim women in Kota Bharu who are above 20 years old. The data were analyzed using the Statistical Package for the Social Sciences (SPSS) version 18.0. The analysis showed that there is significant difference in women’s awareness in relation to their rights after divorce based on age and educational background. However, there is no difference in women’s awarness of their rights based on their marital status.
